TopRete — Terms of Use

These Terms govern the use of the TopRete platform, including its website, PWA and related services. By creating an account or continuing to use TopRete, the user confirms that they have read and agree to these Terms, the Privacy Policy and the Community Guidelines.

1. Role of TopRete

TopRete is a digital platform for interaction between users and businesses. Unless expressly stated otherwise, TopRete is not a seller, buyer, agent or party to a transaction, does not accept payment for goods or services offered by third-party businesses, and does not determine the terms of a transaction between a business and a customer. Any contract for the purchase of goods or services is entered into directly between the business and the customer.

2. Registration

An account is required for some features. Users must provide accurate information and keep access to their account secure. Impersonating another person, creating an account for another person without permission, using the platform fraudulently and circumventing restrictions are prohibited.

3. Business accounts

By creating a business page, the user confirms that they are authorised to represent that business. The business is solely responsible for the accuracy of its information, prices, availability, licences, delivery terms, returns, warranties, the quality of goods and services, and compliance with applicable law.

4. Orders and transactions

TopRete provides a technical mechanism for transmitting an order request. Confirmation by the business means that it has accepted the customer's request. TopRete does not guarantee product availability, fulfilment of an order, the quality of any product or service, conformity with its description, timing, delivery, refunds or warranty service.

5. Payment

Unless expressly stated otherwise, payments are made directly between the customer and the business. TopRete is not a payment intermediary for such transactions.

6. User content

Users retain their rights to their content and grant TopRete a non-exclusive right to store, technically process and display it to the extent necessary to operate, promote and protect the platform.

7. Prohibited content

The following are prohibited: hate speech and incitement to hostility; degrading people on the basis of race, nationality, ethnic origin, religion, sex, gender identity, sexual orientation, disability or other protected characteristics; threats; harassment; targeted insults; fraud; knowingly false or misleading advertising; publishing another person's personal data without a lawful basis; spam; illegal goods and services; malicious content; and attempts to circumvent security systems.

8. Moderation

TopRete may use automated systems, including AI, to identify potential violations. The system may warn a user, temporarily restrict publication, refer material for review or block clearly prohibited content. Automated systems can make mistakes; where reasonably possible, significant decisions should be open to review.

9. Restrictions and removal

TopRete may restrict or remove content, an account or a business in the event of serious or repeated violations of these rules, the law, third-party rights or security requirements.

10. Reports

A user may report a suspected violation. A report is a signal for review and is not automatic proof of a violation.

11. Availability

TopRete features may be changed, added, temporarily disabled or operated in an experimental mode. Continuous and completely error-free operation is not guaranteed.

12. Limitation of liability

To the extent permitted by applicable law, TopRete is not liable for the actions of independent users and businesses, including poor-quality goods, improper services, inaccurate business information, cancellation or non-fulfilment of an order, delay, actions of couriers or third parties, or losses arising directly from a transaction between a user and a third-party business. This does not exclude TopRete's liability where it cannot be limited by law.

13. Deleting a business and an account

Users may delete their business and account using the available features. Some data may be retained in anonymised or restricted form where necessary for security, fraud prevention, dispute resolution, compliance with law or preservation of order-history integrity. If the user is the sole owner of an active business, they may need to delete the business or transfer ownership before deleting their account.

14. Changes to these Terms

Users will be notified by reasonable means of material changes to these Terms.
